OFFICIAL RULES AND REGULATIONS

                                                                                                                                                                                   

           

  1. CONTEST ENTRY PERIODS: The Bell Media and Air Canada Cheer to Win Contest (the “Contest”) starts on July 15, 2013 at 10:00 p.m. Eastern Time (“ET”) and ends on September 16, 2013 at 9:30 p.m. ET.  The Contest Period consists of nine (9) Weekly Entry Periods as follows (each a “Weekly Entry Period” and collectively, the “Weekly Entry Periods”):

 

 

  1. CONTEST SPONSORS: The Contest sponsors are Bell Media Inc. and Air Canada (hereinafter referred to as the “Contest Sponsors”).

 

  1. ELIGIBILITY:  To enter and to be eligible to win, entrant must be a legal resident of Canada and be of the age of majority in the province or territory in which he/she resides at the time of entry into the Contest. Employees and their parents, siblings and children, and persons domiciled with an employee of the Contest Sponsors, their respective agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, are ineligible to enter.

 

  1. HOW TO ENTER:  During the Contest Period, visit the web site located at www.cheertowin.aircanada.com, click on the Contest page and follow the instructions found on the Contest page to complete and submit the official entry form (the “Entry Form”), which: (i) requires you to select the eligible Amazing Race Canada team (as determined by the Contest Sponsors at their sole discretion) you are cheering for; (ii) requires you to create a Contest profile (your “Profile”) by providing your first name, last name, e-mail address, full mailing address, phone number and an eligible password (note: this is only required the first time you submit an Entry Form); (iii) requires you to agree that you have read and agree to be bound by these Official Rules and Regulations (“Rules”); (iv) requires you to accept receiving emails from The Air Canada Cheer to Win Contest;  (v) provides you the option (i.e. it is not required to enter the Contest) of selecting an answer to the bonus question presented (each a “Bonus Question”). When you choose the team you are cheering for, you will receive one (1) entry into the applicable Weekly Prize Draw (as described below) (each, a “Weekly Prize Draw Entry”) and one (1) entry into the Grand Prize Draw (as described below) (each, a “Grand Prize Draw Entry”) (collectively, Weekly Prize Draw Entries and Grand Prize Draw Entries shall be referred to as “Entries” and each, an “Entry”). In addition, if you answered the applicable Bonus Question, you will receive one (1) additional Weekly Prize Draw Entry and one (1) additional Grand Prize Draw Entry. Finally, if you answered the applicable Bonus Question correctly, you will receive one (1) additional Weekly Prize Draw Entry and one (1) additional Grand Prize Draw Entry. After submitting your Entry Form for the first time, for subsequent participation in the Contest, you must sign in to your Profile via the Contest page by following the on-screen instructions and will not be required to perform steps (ii), (iii) and (iv) provided above to submit a subsequent Entry Form.

 

Each entrant may only submit one (1) Entry Form per Weekly Entry Period. If it is discovered that you attempted to submit more than one (1) Entry Form per Weekly Entry Period, all your Entry Forms and all corresponding Entries will be void. Entries shall be associated with the authorized account holder of the email address submitted provided on the applicable Entry Form.  “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  There is one (1) grand prize (the “Grand Prize”) and nine (9) weekly prizes (the “Weekly Prizes”) to be won at the beginning of the Contest Period. No purchase necessary. Void where prohibited. Limit of one (1) Weekly Prize per household.

 

  1. PRIZES:

 

Grand Prize – There is one (1) Grand Prize to be won.  The Grand Prize will mirror the prize featured in The Amazing Race Canada final episode which is currently scheduled to air on CTV television on September 16, 2013.  The Grand Prize consists of travel on Air Canada for one (1) year for two (2) people to any destination that Air Canada flies worldwide (over 175 destinations) in Executive Class/Executive First.  Flights must be on Air Canada only and may apply to flights operated under the Air Canada Express and Air Canada rouge banners. Flights operated by other airlines including Star Alliance® member airlines, codeshare and interline flights are excluded.  There is a maximum of ten (10) round-trip flights for two (2) people.  All travel must be booked and completed between October 1st, 2013 and February 28, 2015 and is subject to space availability at time of booking. Travel blackout dates apply, travel is not permitted between the following dates inclusively: December 15, 2013 to January 7, 2014; March 6, 2014 to March 24, 2014; April 16, 2014 to April 22, 2014; June 20, 2014 to September 2, 2014; December 13, 2014 to January 10, 2015. Certain Air Canada destinations may be restricted to seasonal service only (including, but not limited to, Anchorage, Athens, Barcelona, Cayo Largo del Sur, Curacao, Dublin, Grenada, Huatulco, Ixtapa/Zihuatanejo, Kona, La Romana, Madrid, Rome, San Juan, Sarasota/Bradenton, St. Kitts, St. Maarten and West Palm Beach). No changes permitted to reservations once date of travel is confirmed. Travel does not qualify for Aeroplan mileage accumulation or for mileage accumulation in any other frequent flyer program. The prize winner and his/her travelling companion are responsible for any and all costs not expressly described herein including, without limitation: ground transportation, gratuities, merchandise, telephone calls, personal expenses of any nature for layovers, hotel stays, meals and beverages, service charges, inflight meals and entertainment; costs incurred to and from the major Canadian airport closest to the winner’s place of residence in Canada (hereinafter referred to as the “Departure Point”) as the Prize originates and terminates there; obtaining sufficient personal travel insurance prior to departure, if desired or required; obtaining and carrying all necessary travel documentation, such as passports and visas and complying with customs immigrations regulations. The Grand Prize cannot be sold, converted into cash and is non-transferable and will not be refunded if unused. The Grand Prize must be accepted as awarded and no substitutions, changes or extensions are permitted. The Contest Sponsors reserve the right at their sole discretion to substitute the Grand Prize for one of equal or greater value or allow a prize transfer. The use of upgrade certificates is not permitted for flights. Approximate prize value of the Grand Prize is $80,000 CAD. Exact value of the Grand Prize shall depend on the Departure Point selected by winner, amount of travel, timing and other incidentals.

 

Weekly Prizes – There is one (1) Weekly Prize to be won (as described in Schedule A attached to these Rules during each Weekly Entry Period.  Each Weekly Prize will mirror those featured in The Amazing Race Canada episode airing during the applicable Weekly Entry Period.

 

Before being able to participate in a Prize, each travelling companion, or if under the age of majority, the travelling companion’s parent or legal guardian, will be required to sign and return within the time stipulated by the Contest Sponsors, a full release and indemnity form stating that, among other things, he/she has read and understood these Rules, grants all consents required, agrees to be available and to participate in publicity and/or promotions related to the Contest and/or the Contest Sponsors and/or similar matters, authorizes the Contest Sponsors to broadcast, publish, disseminate and otherwise use his/her name, city/town/village and province/territory of residence, photograph, likeness, sobriquet and voice, in connection with any promotion and/or publicity, and/or for general news, entertainment and/or information purposes at no additional compensation to the travelling companion, beyond his/her participation in the Prize, accepts the Prize as offered and releases the Contest Sponsors from any and all liability of any kind arising out of the travelling companion’s participation in this Contest and receipt and use of the Prize.

 

  1. PRIZE DRAWS:

 

Grand Prize Draw - On September 17, 2013 at 10:15 a.m. ET, a random draw for the Grand Prize (the “Grand Prize Draw”) will take place at Bell Media Inc.’s offices located at 299 Queen Street West, in Toronto, Ontario from among all eligible Grand Prize Draw Entries received during the Contest Period.  The first Grand Prize Draw Entry drawn will be eligible to win the Grand Prize. The odds of winning the Grand Prize will depend on the number of eligible Grand Prize Draw Entries received during the Contest Period. 

 

Weekly Prize Draws At 10:00 a.m. ET on each of the draw dates set out below, a random draw for one (1) Weekly Prize (each, a “Weekly Prize Draw”) will take place at Bell Media Inc.’s offices located at 299 Queen Street West, in Toronto, Ontario, from among all eligible Weekly Prize Draw Entries received during the Weekly Entry Period immediately prior to the applicable Weekly Prize Draw.  The first Weekly Prize Draw Entry drawn during the applicable Weekly Prize Draw will be deemed the potential winner of the applicable Weekly Prize set out in the table below. The odds of winning a Weekly Prize will depend on the number of eligible Weekly Prize Draw Entries received during the applicable Weekly Entry Period.

7.   AWARDING OF PRIZES: Bell Media Inc., acting reasonably, will attempt to contact each potential Prize winner to notify potential winner that he or she may have won a Prize by telephone within two (2) business days after the applicable draw. In the event that a potential winner cannot be contacted within 2 business days after the applicable draw, he or she will be disqualified and an alternate potential winner may be drawn at the Contest Sponsors’ sole discretion. Proof of identification must be provided upon request. In order to be declared a winner, each potential winner must first correctly answer, unaided, a time limited mathematical skill testing question administered by Bell Media Inc. Before being awarded a Prize, each potential winner will be required to sign and return within the time stipulated by the Contest Sponsors, a full release and indemnity form stating that, among other things, he/she has read and understood these Rules, grants all consents required, agrees to be available and to participate in publicity and/or promotions related to the Contest and/or the Contest Sponsors and/or similar matters, authorizes the Contest Sponsors to broadcast, publish, disseminate and otherwise use his/her name, city/town/village and province/territory of residence, photograph, likeness, sobriquet and voice, in connection with any promotion and/or publicity, and/or for general news, entertainment and/or information purposes at no additional compensation to the potential winner, beyond the awarding of or participation in the applicable Prize, accepts the applicable Prize as offered and releases the Contest Sponsors from any and all liability of any kind arising out of the potential winner’s participation in this Contest and receipt and use of the applicable Prize. In the event that a potential winner does not comply with all the provisions as contemplated in these Rules, Contest Sponsors shall have the right to disqualify such potential winner, and draw an alternate potential winner, and the Contest Sponsors shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner shall be applied, with the necessary amendments, until all qualified winners have been duly selected, but in any event, no later than September 23, 2013.

 

  1. By entering this Contest the entrants and participants automatically agree to accept and abide by these Rules. All decisions of the Contest Sponsors with respect to any aspect of this Contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this Contest.

 

  1. All Entries become property of Contest Sponsors who assume no responsibility for garbled, lost, late, delayed, destroyed or misdirected entries, mail, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with entrants requesting Rules by mail or requesting the names of the Prize winners (for which a self-addressed, postage paid envelope must be included). Contest Sponsors do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials or data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsors, in their sole discretion, the Contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, Contest Sponsors reserve their right (subject only to the consent of the Regie des alcools, des course et des jeux) to cancel, terminate, modify, amend, extend or suspend the Contest, and select a winner from previously received eligible Entries. Contest Sponsors reserve their right (subject only to the consent of the Regie des alcools, des course et des jeux) to modify the Rules without materially affecting the terms and conditions hereof. The Contest Sponsors reserve their right in their sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Contest or to be acting in violation of the Rules or otherwise in a disruptive manner. Any attempts to deliberately damage the Contest web site or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made the Contest Sponsors reserve their right to seek remedies and damages to the fullest extent of the law. Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this Contest or from downloading any material from the Contest web site. For Quebec residents, any litigation respecting the conduct or organization of this Contest may be submitted to the Regie des alcools, des courses et des jeux du Quebec for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement. 

 

10. Contest is subject to all applicable federal, provincial and municipal laws and regulations. Personal information collected from entrants will be used by Contest Sponsors for the purpose of administering this Contest and, if consent is given at the time of entry, to provide the entrants with marketing information relating to new and existing products and upcoming promotions of by mail or e-mail. Entrants are able to opt-in with respect to receiving such marketing information online. The Contest Sponsors will not sell, share or otherwise disclose personal information of entrants with third parties, other than to third parties engaged by them to fulfill the above purposes or as permitted or required by law. By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in Air Canada's privacy policy, which is available at http://www.aircanada.com/en/about/legal/privacy/policy.html and Bell Media Inc.’s privacy policy, which is available at http://www.bellmedia.ca/about/Media_Privacy.page.  Any inquiry concerning the personal information held by the Contest Sponsors should be addressed to Bell Media Inc. at 299 Queen Street West, Toronto ON M5V 2Z5.

11. In the event of any discrepancy or inconsistency between the terms and conditions of the Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest entry form, or point of sale, television, print or online advertising, the terms and conditions of the Rules shall prevail, govern and control. In the event of any discrepancy or inconsistency between the English and French version of the Rules, the English version shall prevail.

 

  1. All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsors and/or their affiliates who are each authorized users of each other’s intellectual property. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

All travel must be booked and completed between October 1st, 2013 and December 14, 2014 and is subject to space availability at time of booking. Travel blackouts apply, travel is not permitted between the following dates inclusively: December 15, 2013 to January 7, 2014; April 16, 2014 to April 22, 2014. (4)  Weekly Entry Period Four Prize consists of one (1) Air Canada Vacations’ Package for the winner and his/her traveling companion to a destination to be announced during the episode of The Amazing Race Canada airing on CTV television during the Weekly Entry Period Four on August 5, 2013. Weekly Entry Period Four Prize includes: two (2) Economy Class round-trip tickets on Air Canada for winner and his/her traveling companion; seven (7) nights’ hotel stay in standard double occupancy room. Hotel package includes: 3 meals daily; snacks, unlimited local drinks, daily activities program, non-motorized sports and nightly entertainment. All travel and hotel stay must be booked and completed between October 1st, 2013 and December 14, 2014 and is subject to space availability at time of booking.  Hotel reservations are subject to complimentary allotment and may not be available even if rooms and/or air are available on the brand specific website or through another travel partner. Reservations must be made a minimum of 120 days prior to departure for travel between January and April and 30 days prior to departure for travel between May and December. (5)  Weekly Entry Period Five Prize consists of two (2) Economy Class round-trip tickets on Air Canada for winner and his/her traveling companion valid for travel within a region to be announced during the episode of The Amazing Race Canada airing on CTV television during the Weekly Entry Period Five on August 12, 2013. All travel must be booked and completed between October 1st, 2013 and December 14, 2014 and is subject to space availability at time of booking.  Travel blackouts apply, travel is not permitted between the following dates inclusively: December 15, 2013 to January 7, 2014; April 16, 2014 to April 22, 2014. Certain destinations are restricted to seasonal service only. Approximate retail value of the Weekly Entry Period Five Prize is $3,500 CAD. (6)  Weekly Entry Period Six Prize consists of two (2) Economy Class round-trip tickets on Air Canada for winner and his/her traveling companion valid for travel between Canada and a region to be announced during the episode of The Amazing Race Canada airing on CTV television during the Weekly Entry Period Six on August 19, 2013. All travel must be booked and completed between October 1st, 2013 and December 14, 2014 and is subject to space availability at time of booking. Travel blackouts apply, travel is not permitted between the following dates inclusively: December 15, 2013 to January 7, 2014; April 16, 2014 to April 22, 2014; June 20, 2014 to September 2, 2014. Certain destinations are restricted to seasonal service only (including, but not limited to, Athens, Barcelona, Dublin, Madrid, Rome, Venice, Edinburgh). Approximate retail value of the Weekly Entry Period Five Prize is $4,000 CAD. Exact value depends on the Departure Point and destination selected by winner, timing and other incidentals.

 

(7)  Weekly Entry Period Seven Prize consists of two (2) Economy Class round-trip tickets on Air Canada for winner and his/her traveling companion valid for travel between Canada and a region to be announced during the episode of The Amazing Race Canada airing on CTV television during the Weekly Entry Period Seven on August 26, 2013. All travel must be booked and completed between October 1st, 2013 and December 14, 2014 and is subject to space availability at time of booking. Travel blackouts apply, travel is not permitted between the following dates inclusively: December 15, 2013 to January 7, 2014; March 6, 2014 to March 24, 2014; April 16, 2014 to April 22, 2014. Certain destinations are restricted to seasonal service only (including, but not limited to Cayo Largo del Sur, Curacao, Grenada, Huatulco, Ixtapa/Zihuatanejo, La Romana, San Juan, Sarasota/Bradenton, St. Kitts, St. Maarten). Approximate retail value of the Weekly Entry Period Seven Prize is $4,000 CAD. Exact value depends on the Departure Point and destination selected by winner, timing and other incidentals.

 

(8)  Weekly Entry Period Eight Prize consists of two (2) Economy Class round-trip tickets on Air Canada for winner and traveling companion valid for travel between Canada and a region to be announced during the episode of The Amazing Race Canada airing on CTV television during the Weekly Entry Period Eight on September 2, 2013. All travel must be booked and completed between October 1st, 2013 and December 14, 2014 and is subject to space availability at time of booking. Travel blackouts apply, travel is not permitted between the following dates inclusively: December 15, 2013 to January 7, 2014; April 16, 2014 to April 22, 2014; June 20, 2014 to September 2, 2014. Certain destinations are restricted to seasonal service only. Approximate retail value of the Weekly Entry Period Eight Prize is $3,500 CAD. Exact value depends on the Departure Point and destination selected by winner, timing and other incidentals.

 

(9) Weekly Entry Period Nine Prize consists of Air Canada Altitude Super Elite 100K Status for two (2) years for the winner and a designated partner. Privileges of Air Canada Altitude Super Elite 100K include Priority Reservation Services, Priority Airport Services, Lounge Access, eUpgrades and Exclusive Rewards. Air Canada Altitude Super Elite 100K 2013 and 2014 status will be awarded to the winner and an assigned partner and such status will be valid until February 28, 2015. Although this status cannot be purchased, the approximate retail value of the Weekly Entry Period Nine Prize is $10,000 CAD. Winner and assigned partner must be Aeroplan members in good standing; participants can enrol at www.aeroplan.com. Aeroplan membership is free. Air Canada Altitude status is a privilege, which can be revoked by Air Canada at its discretion. Any act or omission by the Air Canada Altitude member or anyone acting on his/her behalf which is detrimental to Air Canada or any of its partners in Air Canada Altitude, may result in any or all of the following: revocation of membership, prohibition of membership for a number of years regardless of flying activity, revocation of mileage accumulation as part of Air Canada Altitude, without prejudice to any other rights or recourses of Air Canada, including but not limited to the right to recover damages. Air Canada will not be responsible for lost or delayed mail correspondence, or otherwise shall be under no obligation to continue Air Canada Altitude, or to provide any notice of its termination. Air Canada reserves the right to terminate Air Canada Altitude at any time. Air Canada assumes no liability toward members for anything, including but not limited to, the cessation of airline partnerships, changes to program benefits & policies, adjustments to mileage accumulation or redemption eligibility, availability of redemption or upgrade seats, definition of and/or revisions to the Air Canada Altitude qualification period or benefit year for status recognition, or access to airport lounges. Air Canada Altitude membership is solely for the benefit of the individual who has been granted Altitude privileges, and cannot be shared. eUpgrade Credits awarded as part of Air Canada Altitude membership are subject to the terms and conditions of the eUpgrade Program, which can be reviewed at aircanada.com/eupgrades. Access to the Maple Leaf Lounge as part of Air Canada Altitude membership is subject to the terms and conditions of the Maple Leaf Lounges, which can be reviewed at aircanada.com/lounge.  In the event the winner of the Weekly Entry Period Nine Prize is already an Air Canada Altitude Super Elite 100K Status holder, the winner may transfer it, subject to Air Canada’s approval, to a person chosen by the winner and such person shall be subject to the applicable terms and conditions provided herein.

 

Additional Weekly Prizes Terms and Conditions:  Flights apply to any destination in the region awarded served by Air Canada and may apply to flights operated under the Air Canada Express and Air Canada rouge banners. Flights operated by other airlines including Star Alliance® member airlines, codeshare and interline flights are excluded. No changes permitted to reservations once date of travel is confirmed. Travel does not qualify for Aeroplan mileage accumulation or for mileage accumulation in any other frequent flyer program. The prize winner and his/her travelling companion are responsible for any and all costs not expressly described herein including, without limitation, applicable local air departure taxes, ground transportation, gratuities, merchandise, telephone calls, personal expenses of any nature for overnight layover, meals and beverages, service charges, inflight meals and entertainment; costs incurred to and from the Departure Point as the Prize originates and terminates there; obtaining sufficient personal travel insurance prior to departure, if desired or required; obtaining and carrying all necessary travel documentation, such as passports and visas and complying with customs immigrations regulations. The use of upgrade certificates is not permitted for flights.  Weekly Prizes cannot be sold, converted into cash, are non-transferable (with the exception of the Weekly Entry Period Nine Prize winner’s Air Canada Altitude Super Elite 100K Status, as provided above) and will not be refunded if unused. Weekly Prizes must be accepted as awarded and no substitutions, changes or extensions are permitted. The Contest Sponsors reserve the right at their sole discretion to substitute the Weekly Prize for one of equal or greater value or allow a prize transfer.
